These Driver Terms of Use ("Terms") govern your use of the SmartCabPro Driver App and related services.
By logging into or using the Driver App, you agree to these Terms.
The Driver App is software provided by SMARTCABPRO LLC.
SmartCabPro is not your employer, transportation company, fleet operator, dispatch company, or supervisor.
You provide transportation services only through the Transportation Provider that has authorized your account.
Nothing in these Terms creates an employment, agency, partnership, or joint venture relationship between you and SmartCabPro.
You accept these Terms by:
Electronic acceptance has the same legal effect as a handwritten signature where permitted by law.
You represent that:
Your driver account belongs to you but is managed by the Transportation Provider that authorizes your access.
Your Transportation Provider may activate, suspend, or request deactivation of your account.
SmartCabPro may also suspend or deactivate accounts in accordance with applicable agreements and these Terms.
Your Transportation Provider keeps a file on you in the Platform. It may include:
Questions about your work, pay or status go to your Transportation Provider.
The Driver App is intended solely for authorized transportation-related activities.
You agree to use the Driver App only for lawful purposes and in accordance with these Terms and your Transportation Provider's policies.
You are responsible for:
The Driver App assists your work but does not replace your professional judgment.
Safety comes first.
You must always comply with applicable traffic laws and avoid interacting with the Driver App in a manner that creates an unreasonable safety risk.
Where possible, use hands-free features or interact with the application only when it is safe to do so.
Office and passenger messages may take over the screen. Read or reply only when your vehicle is safely stopped. Never read or type while driving, and always obey New Jersey's hands-free law (N.J.S.A. 39:4-97.3) and all other distracted-driving laws.
The Driver App keeps the screen on while you are signed in.
Holding the SOS button for two seconds sends a silent alarm to your company's office staff only. The alarm shows your name, your car and your live location, updated every few seconds, until the office closes it. Staff record how and by whom the alarm was closed.
The Driver App and SmartCabPro do not contact 911 or the police. Call 911 yourself whenever you can.
SmartCabPro does not watch, receive, answer or act on SOS alarms. The software only carries the alarm to your company's own office staff. Whether anyone sees it, and what is done about it, is entirely your Transportation Provider's responsibility. SOS depends on your phone, its battery, GPS, a working data connection, and on office staff being signed in and looking at the screen. Delivery is not guaranteed and can be delayed or fail. Never rely on SOS as your way of getting help — call 911.
SOS does not let anyone listen in. Deliberate false alarms may be treated as misuse under your Transportation Provider's policies.

Some features may not function correctly if your device does not meet minimum requirements.
The Driver App downloads and applies updates to its content automatically when it opens, without asking. Versions provided outside the app stores may ask your permission to install new versions. The Driver App reports its installed version to your Transportation Provider.
If you downloaded the Driver App from the Apple App Store or Google Play:
While you are on shift, the Driver App collects your device's location — including when the app is running in the background and when your device's screen is off or locked. Location collection ends when you end your shift or sign out.
This collection supports transportation services while you are actively working for your Transportation Provider.
Background location may be used for:
Location collection is intended only to support the operation of the transportation service.
Background location collection is tied to your working status.
Location collection runs from the moment you sign in to a car until your shift ends in one of the ways listed in Section 10. It does not run while you are signed out.
Depending on your device and the features enabled by your Transportation Provider, the Driver App may request permission for:
Permissions are requested only to support Platform functionality. Some features may not operate if required permissions are denied.
GPS accuracy depends on many factors outside SmartCabPro's control, including satellite coverage, buildings, tunnels, weather, device hardware, and network conditions.
Accordingly, location information may occasionally be delayed or inaccurate.
When you tap navigate, the trip address opens in the navigation app you choose (such as Google Maps, Waze or Apple Maps). That app works under its own terms and privacy policy. You use it by your own choice and at your own risk.
Location and operational information are processed in accordance with the SmartCabPro Privacy Policy.
The Transportation Provider may access information reasonably necessary to manage dispatch operations, monitor active drivers, review trip activity, and administer its business.

AI-generated information is intended to assist operations and should not replace professional judgment.
The company radio is an optional feature. It is not available today. If it is offered in the future, it is off by default. It is turned on for a company only by SmartCabPro, at the company's request, and SmartCabPro or the company's manager can turn it off at any time. If your company's radio is on:
The radio is not an emergency system and never replaces SOS or 911.
Drivers agree to:
You may revoke certain device permissions through your device settings.
However, if required permissions are disabled, some or all Driver App functionality may be unavailable.
The Driver App may only be used for legitimate transportation services authorized by the Transportation Provider.
Drivers agree not to:
A driver's access may be temporarily suspended or permanently disabled if your Transportation Provider reasonably determines that the driver has:
Where appropriate, the Transportation Provider may investigate the matter before restoring access.
SmartCabPro may disable access to the software itself for security, billing or terms-of-use reasons — for example a compromised account, or an attempt to reach systems you are not entitled to. SmartCabPro does not assess driving conduct, passenger safety, fitness to drive, or compliance with transportation law, and does not suspend drivers on a company's behalf. Those decisions belong to your Transportation Provider.
Your company's manager can suspend you for a set time of up to 90 days, normally with a written reason. While suspended, you cannot sign in, go available, accept offers or be assigned trips. The suspension lifts by itself at the end date, or earlier if a manager lifts it, and a record stays in the company's fleet log (see Section 4A).
Your Transportation Provider may require your licence, insurance, registration and other papers, and keeps them in SmartCabPro so they are in one place. Here is exactly what that means, and what it does not.
What the software does. It stores the documents and expiry dates your company types in or uploads, and shows them back to your company and to you. Photos of papers you take in the Driver App go to your company's private storage; its staff review them and either approve them or send them back with a reason you can read. Papers with expiry dates already in the past are refused at upload. If your company turns on the document check, an expired paper blocks you or the car from going available and receiving trips, and can take you offline — that check is your company's setting, not ours.
What the software does not do. SmartCabPro does not check whether a document is real, correct, current, valid, or issued to you. It does not contact any authority, insurer or agency. It does not know about any paper that was never entered, and it cannot tell that something entered is wrong. If a date is typed in wrongly, or a document is missing from the system altogether, the software has no way of knowing and will say nothing.
Reminders are a convenience, not a safeguard. At your first sign-in each day the Driver App may show papers that have expired or will expire within 10 days, and your company may send its own reminders inside the Driver App. A reminder may be late, may be wrong because the information given to us was wrong, or may not appear at all — because of a date nobody entered, a phone that was off, a lost connection, or a fault in the software. Never rely on SmartCabPro to tell you that a document is expiring. Keeping your licence, insurance, registration and any other paper valid is yours and your company's responsibility, exactly as it was before this software existed.
We are not responsible for documents. SmartCabPro is not responsible for any licence, permit, insurance policy, registration, inspection or other document — for its validity, its expiry, its renewal, or for any fine, penalty, loss, suspension or claim arising from one being missing, expired, incorrect or unlawfully used.
You can use it, or not. These reminders are offered to help. Your company chooses whether to use them, and nobody is required to. Using the software is not a substitute for your own records.
If your Transportation Provider enables it (it is off by default), its manager can sign in with office credentials, never with your code, on the device you use, including a shared car tablet. The manager can then manage drivers, cars, papers and dues and view the live fleet map. Manager sessions lock automatically, are logged with the device, and leave no manager data on it.
Your Transportation Provider may record dues or lease payments for your car (amount, method, note, staff member and time). It may text a receipt to the car owner's phone, or to your phone if the dues are billed to you. SmartCabPro does not collect or hold these funds. Any dispute about them is between you and your Transportation Provider.

Questions regarding employment or contractor status must be directed to the Transportation Provider.
Insurance. SmartCabPro provides no insurance of any kind to anybody. It does not insure vehicles, drivers, passengers, staff or companies, and it provides no motor, liability, health, life, disability, occupational-accident or workers' compensation cover. Every vehicle used with this software must carry whatever insurance the law where it operates requires, arranged and paid for by its owner or its company. SmartCabPro does not verify that any such insurance exists, is valid, or is adequate, and takes no part in any claim.
We do not check anyone. SmartCabPro does not screen, vet, interview, train, supervise or run background checks on drivers, and does not verify anyone's licence, permit, medallion, driving record, vehicle insurance, registration or the roadworthiness of any vehicle.
Accidents and injuries. SmartCabPro is software. It does not drive, carry passengers, maintain vehicles, or run an office. SmartCabPro is not responsible for any accident, collision, injury, illness, death, damage, loss or theft — whether it happens in a vehicle, in an office, on the street, or anywhere else — and whether it involves a driver, a passenger, a member of staff, or anyone else. Responsibility for what happens during a journey, in a workplace, or in a vehicle sits with the people and companies involved, and with their insurers.
SmartCabPro is provided as it is. It can contain mistakes, show wrong or out-of-date information, run slowly, lose a message, miss a reminder, or stop working for a while. It depends on phones, batteries, GPS, mobile networks and outside services, none of which SmartCabPro controls.
People using it can make mistakes too. A dispatcher can send the wrong car, type the wrong address, or read something wrongly on a screen. A driver or a passenger can enter something incorrectly. SmartCabPro shows what it is given; it does not check whether that is right.
Every decision made while using this software is the decision of the person or company making it. SmartCabPro does not guarantee that the software is available, accurate, uninterrupted or error-free, and is not responsible for any loss arising from an error, a delay, an outage, a missing message, or a mistake made by anybody using it.

These matters remain the responsibility of the Transportation Provider and the driver as applicable.
Driver access may end if:
Termination of Driver App access does not affect rights or obligations that arose before termination.
In-app card payments are not currently offered. A passenger may choose card, the trip then shows a card sign, and you collect the fare in the vehicle with your own or your company's equipment, outside SmartCabPro. No SmartCabPro fee applies.
Sections 24 through 31 below apply only if in-app card payments are enabled in the future. You will be given notice before that happens.
The Driver App may offer the ability to accept card payments from riders for completed rides ("Ride Payments"). Use of Ride Payments is optional and may be enabled or disabled by SmartCabPro or your Transportation Provider.
To accept card payments you must connect a payment account with Stripe, Inc. ("Stripe"), our payment processor. Your Stripe account belongs to you. Your use of it is governed by the Stripe Connected Account Agreement, including the Stripe Services Agreement.
Your bank details, identity documents, and tax identification information are collected and held by Stripe — never by SmartCabPro. Card numbers are entered only on Stripe-hosted payment pages; SmartCabPro never sees or stores card numbers.
Riders may choose to pay in cash. Cash payments are handled directly between you, the rider, and your Transportation Provider under its policies — SmartCabPro and Stripe are not involved in cash transactions and charge no fee on them.
Refunds and payment disputes are matters between you, your Transportation Provider, the rider, and Stripe or the rider's card issuer.
If a rider disputes a card charge (a "chargeback"), the disputed amount and any associated card-network fees are debited from your Stripe account, in accordance with the Stripe Connected Account Agreement. Keep reasonable records of your rides (the app's trip history helps) to respond to disputes.
SmartCabPro provides the software that facilitates payment requests but is not a party to the fare transaction between you and the rider and does not guarantee payment, resolve disputes, or act as an escrow, bank, or money transmitter.
You are solely responsible for your own taxes on amounts you receive through Ride Payments.
Where required by federal or state law, you will receive an IRS Form 1099-K reporting your card payment volume (thresholds vary; some states, including New Jersey, require reporting at lower amounts). The tax information used for this reporting is the information you provided to Stripe when connecting your account. Nothing in these Terms is tax advice — consult your own tax professional.
You agree to request card payments only for real rides you actually performed, only for the actual amount owed under your Transportation Provider's pricing, and never to use Ride Payments to move money unrelated to transportation services. Misuse may result in suspension of payment features or your account, and may be reported to Stripe.
SmartCabPro never holds, controls, or transmits your funds. All funds movement is performed by Stripe. If Ride Payments are unavailable for any reason (including Stripe service interruptions), you may still complete rides and collect payment by any method your Transportation Provider permits.
SmartCabPro may update these Driver Terms from time to time.
Material updates may require drivers to review and electronically accept the revised Terms before continuing to use the Driver App.

These Driver Terms are governed by the laws specified in the applicable Platform Service Agreement between SmartCabPro and the Transportation Provider, except where mandatory local law requires otherwise.
These Driver Terms become effective when the driver first accepts them electronically or first uses the Driver App after being presented with these Terms.
