Rider Terms of Use

These Rider Terms of Use ("Terms") govern the use of the SmartCabPro Passenger App and related services.

By creating an account, booking a ride, or using the Passenger App, you agree to these Terms.

CHAPTER 1 — INTRODUCTION & ACCEPTANCE

1. Relationship Between SmartCabPro and Transportation Providers

SmartCabPro LLC develops and provides software that enables independent Transportation Providers to manage transportation services.

SmartCabPro is not a transportation company.

CHAPTER 2 — BOOKING RIDES

The Passenger App allows you to submit ride requests to participating Transportation Providers.

Estimated pickup and arrival times are estimates only.

Actual arrival times may vary due to traffic, weather, road closures, driver availability, or other factors beyond SmartCabPro's reasonable control.

Where fare estimates are displayed, they are estimates only unless your Transportation Provider expressly guarantees fixed pricing.

Passengers may cancel rides in accordance with the cancellation policies established by the applicable Transportation Provider.

Cancellation fees may apply where disclosed before or during the booking process.

CHAPTER 3 — PAYMENTS, SAFETY, PRIVACY, LIABILITY & TERMINATION

10. Payments

Passengers agree to pay all applicable fares, taxes, tolls, waiting charges, cancellation fees, tips (if any), and other charges established by the Transportation Provider.

Paying by card. Where card payment is available, your fare is charged for a ride that is in progress or completed, at the amount entered by your driver or the Transportation Provider's staff under the provider's pricing. Card payments are processed by Stripe, Inc. on Stripe-hosted payment pages — SmartCabPro never sees or stores your card number. The payment goes to your driver's payment account; SmartCabPro receives a small platform service fee from the fare portion.

Tips. Tips are voluntary. 100% of your tip goes to your driver — SmartCabPro charges no platform fee on tips.

Paying cash. You may choose to pay in cash instead. Cash payments are handled directly with your driver under the Transportation Provider's policies; Stripe and SmartCabPro are not involved in cash transactions.

Receipts. For card payments, your payment confirmation comes from the Stripe payment page; the app also shows your paid status for the ride.

11. Refunds & Payment Disputes

Refund requests should first be submitted to the applicable Transportation Provider — they set the fare and provide the ride, so they can resolve most issues fastest.

If you believe a card charge is incorrect and the Transportation Provider has not resolved it, you may also contact your card issuer. Card disputes are handled between you, your card issuer, Stripe, and the driver's payment account under card-network rules.

SmartCabPro may assist in facilitating communication regarding disputes but is not a party to the fare transaction and is not responsible for refund decisions made by the Transportation Provider unless SmartCabPro directly collected the payment and applicable law requires otherwise.

12. Passenger Safety

Passengers should:

Do not use the Platform to request police, fire, ambulance, or other emergency assistance.

13. Ratings and Feedback

Passengers may submit ratings, reviews, and feedback.

Feedback should be truthful, respectful, and based on actual experience.

SmartCabPro or the Transportation Provider may remove content that is fraudulent, abusive, defamatory, discriminatory, unlawful, or otherwise violates these Terms.

14. Lost Property

SmartCabPro is not responsible for property left in vehicles.

Passengers should contact the Transportation Provider through available communication channels to report lost items.

Recovery of lost property cannot be guaranteed.

15. Privacy

Passenger information is processed in accordance with the SmartCabPro Privacy Policy.

Information may be shared with the Transportation Provider only as reasonably necessary to complete the requested transportation service.

16. Limitation of SmartCabPro's Responsibility

SmartCabPro provides software that facilitates ride requests.

SmartCabPro is not responsible for:

21. Governing Law

These Rider Terms are governed by the laws specified in the applicable Platform Service Agreement, except where mandatory local law requires otherwise.
