Rider Terms of Use

SMARTCABPRO LLC · Version 1.3 · Effective September 17, 2026 (v1.3 says plainly that SmartCabPro checks nobody — no vetting, no background checks, no verifying licences or insurance — provides no insurance of any kind, is not responsible for accidents anywhere, and can itself make mistakes)

These Rider Terms of Use ("Terms") govern the use of the SmartCabPro Passenger App and related services.

By creating an account, booking a ride, or using the Passenger App, you agree to these Terms.

CHAPTER 1 — INTRODUCTION & ACCEPTANCE

1. Relationship Between SmartCabPro and Transportation Providers

SmartCabPro LLC develops and provides software that enables independent Transportation Providers to manage transportation services.

SmartCabPro is not a transportation company.

SmartCabPro does not:

Transportation services are provided solely by the independent Transportation Provider that accepts your ride request.

We do not check anyone. SmartCabPro does not screen, vet, interview, train, supervise or run background checks on drivers, and does not verify anyone's licence, permit, medallion, driving record, vehicle insurance, registration or the roadworthiness of any vehicle. Your ride is provided by a taxi company that chooses and is responsible for its own drivers and its own vehicles. SmartCabPro is the software that company uses to take bookings and manage its cars.

Insurance. SmartCabPro provides no insurance of any kind to anybody. It does not insure vehicles, drivers, passengers, staff or companies, and it provides no motor, liability, health, life, disability, occupational-accident or workers' compensation cover. Every vehicle used with this software must carry whatever insurance the law where it operates requires, arranged and paid for by its owner or its company. SmartCabPro does not verify that any such insurance exists, is valid, or is adequate, and takes no part in any claim.

Accidents and injuries. SmartCabPro is software. It does not drive, carry passengers, maintain vehicles, or run an office. SmartCabPro is not responsible for any accident, collision, injury, illness, death, damage, loss or theft — whether it happens in a vehicle, in an office, on the street, or anywhere else — and whether it involves a driver, a passenger, a member of staff, or anyone else. Responsibility for what happens during a journey, in a workplace, or in a vehicle sits with the people and companies involved, and with their insurers.

The software is not perfect. SmartCabPro is provided as it is. It can contain mistakes, show wrong or out-of-date information, run slowly, lose a message, or stop working for a while, and it depends on phones, networks and outside services it does not control. People using it can make mistakes too — a dispatcher can send the wrong car or type the wrong address. SmartCabPro does not guarantee that the software is available, accurate, uninterrupted or error-free, and is not responsible for any loss arising from an error, a delay, an outage, a missing message, or a mistake made by anybody using it.

1A. Company Apps and Company Codes

The Passenger App may carry a taxi company's own name and logo, or it may connect you to a taxi company through a company code. These Terms apply to every version of the Passenger App.

When you use a company's app or code, your bookings go only to that company, and that company is the Transportation Provider for your ride.

Each company keeps its own separate passenger account and ride history for your phone number. Your account and rides with one company are not shared with another company.

Booking through a company may stop working if that company's SmartCabPro trial or subscription ends, or if the company stops using SmartCabPro.

CHAPTER 2 — BOOKING RIDES

5. Requesting a Ride

The Passenger App allows you to submit ride requests to participating Transportation Providers.

Submitting a ride request does not guarantee that a driver will accept or complete the request.

Ride availability depends on factors such as:

Accessibility needs. If you need a wheelchair-accessible vehicle or other assistance, tell the company when you book. Accessible vehicles and assistance are provided by the Transportation Provider under its own legal obligations and are not guaranteed by SmartCabPro.

5A. Booking by Phone

When you call a taxi company that uses SmartCabPro, your call may be answered by:

You may be placed on hold first. If no one is free within a short wait, the AI booking agent may answer. If no one can take your call, you will hear a short message and your phone number is kept so the company can call you back.

Calls answered by the AI booking agent are recorded and transcribed. Those recordings and transcripts are held by SmartCabPro's AI service providers for the company you called and can be provided to that company on request. Calls answered through SmartCabPro by company staff or SmartCabPro dispatch desk personnel are not recorded.

The AI booking agent recognizes you by the phone number you call from, using only the records of the company you called. It may greet you by name, read back addresses and entrance details from your past rides with that company, and answer in your saved language. It can book a ride or cancel your most recent ride that has not yet finished. Anyone who calls from your phone may hear those details and book or cancel that ride.

The AI booking agent can mishear. Listen carefully when it reads your booking back to you, and correct anything that is wrong before you finish the call.

Company phone lines and the AI booking agent are not emergency services. In an emergency, call 911.

5B. Scheduled Rides

You may schedule a ride ahead of time in the Passenger App or with the AI booking agent, up to thirty (30) days ahead. A pickup time given by phone without a time zone is treated as Eastern Time.

A scheduled ride is sent to drivers shortly before the pickup time. A driver is not guaranteed.

Always check the date and time shown or read back to you when you schedule a ride.

5C. Location and Maps

If you allow location access, the Passenger App uses your phone's current location while you book, to centre the map and to rank nearby address suggestions. Your location is sent to our map and address-search providers for that purpose.

When you tap Book, the app records your phone's location at that moment, or the most recent location it read if a new reading is not available, and shows it to the company to help confirm your pickup.

The map may show nearby cars, without driver names. Once your ride is booked, it may show your car's live position, car number, and estimated arrival.

The Passenger App uses Google Maps features. Your use of those features is subject to the Google Maps/Google Earth Additional Terms of Service and the Google Privacy Policy.

6. Estimated Arrival Times

Estimated pickup and arrival times are estimates only.

Actual arrival times may vary due to traffic, weather, road closures, driver availability, or other factors beyond SmartCabPro's reasonable control.

7. Fare Estimates

Where fare estimates are displayed, they are estimates only unless your Transportation Provider expressly guarantees fixed pricing.

Actual fares may vary based on:

Prices are set by the Transportation Provider. A price may be shown as a fixed price, as a price range that is settled by the meter, or as an estimated metered fare.

A price may include extras set by the Transportation Provider, such as charges for extra passengers, bags, stops, or waiting time, date or zone surcharges, and round-trip rules. Tolls are not included in the price shown and may be charged in addition.

Where an address cannot be matched to an exact map location, any price shown is only an estimate.

Whether a price is shown in the app is up to the Transportation Provider. If you choose card, the Transportation Provider may add a card fee, and any price shown for that booking includes it.

8. Ride Cancellation

Passengers may cancel rides in accordance with the cancellation policies established by the applicable Transportation Provider.

Cancellation fees may apply where disclosed before or during the booking process.

9. Passenger Conduct

Passengers agree to:

Transportation Providers may refuse service where permitted by applicable law.

9A. Blocked Phone Numbers

A Transportation Provider may block a phone number from booking with it.

A blocked number may be refused when booking in the apps and by phone. Calls from a permanently blocked number may be answered with a short message and then ended.

A block by one company does not affect your use of other companies on SmartCabPro.

If you believe your number was blocked by mistake, contact that company.

CHAPTER 3 — PAYMENTS, SAFETY, PRIVACY, LIABILITY & TERMINATION

10. Payments

Passengers agree to pay all applicable fares, taxes, tolls, waiting charges, cancellation fees, tips (if any), and other charges established by the Transportation Provider.

Card or cash. When you book, you may tell the company whether you will pay by card or by cash. This is a choice you share with the company, not a charge made through the app.

Paying in the vehicle. In-app card payments are not currently offered. Payment is collected by your driver in the vehicle under the Transportation Provider's policies. While in-app card payments are off, SmartCabPro does not process ride payments and does not take a fee from fares. If in-app card payments are offered in the future, these Terms will be updated first.

Tips. Tips are voluntary and are handled in the vehicle. SmartCabPro takes no part of any tip.

Receipts. The Transportation Provider may email you a receipt showing the fare it recorded for your ride.

Corporate accounts. If a ride is billed to a corporate or business account, the ride, including its pickup and drop-off addresses and department, appears on the invoice sent to the account holder.

11. Refunds & Payment Disputes

Refund requests should first be submitted to the applicable Transportation Provider — they set the fare and provide the ride, so they can resolve most issues fastest.

If you believe a card charge is incorrect and the Transportation Provider has not resolved it, you may also contact your card issuer.

SmartCabPro is not a party to fare payments. SmartCabPro may help with communication about a dispute, but it is not responsible for refund decisions made by the Transportation Provider.

12. Passenger Safety

Passengers should:

The Passenger App is not an emergency service.

Do not use the Platform to request police, fire, ambulance, or other emergency assistance.

12A. Two-Way Radio in Vehicles (Where a Company Uses It)

SmartCabPro is developing an optional push-to-talk radio that lets a taxi company's drivers and dispatch staff talk to each other. It is not yet available, it is off by default, and it will be used only by a company that turns it on.

Where a company uses it, the radio is push-to-talk only. While the driver holds the talk button, sounds inside the vehicle, including conversation, may be heard live by that company's drivers and dispatch staff. You may also hear radio messages from dispatch and other drivers in the vehicle.

SmartCabPro does not record the radio. People on the channel could record it with their own devices, and SmartCabPro cannot prevent this.

If you are on a call with a company that uses the radio and a staff member talks on the radio, you will normally be placed on hold. If the staff member chooses to let you hear, you may briefly hear the radio exchange, including drivers' replies.

13. Ratings and Feedback

Passengers may submit ratings, reviews, and feedback.

Feedback should be truthful, respectful, and based on actual experience.

SmartCabPro or the Transportation Provider may remove content that is fraudulent, abusive, defamatory, discriminatory, unlawful, or otherwise violates these Terms.

Your ratings and written comments go to the Transportation Provider, linked to the driver and the ride, and the Transportation Provider may export them. The driver sees only an average rating.

14. Lost Property

SmartCabPro is not responsible for property left in vehicles.

Passengers should contact the Transportation Provider through available communication channels to report lost items.

Recovery of lost property cannot be guaranteed.

15. Privacy

Passenger information is processed in accordance with the SmartCabPro Privacy Policy.

Information may be shared with the Transportation Provider only as reasonably necessary to complete the requested transportation service.

Text messages. Text messages, such as sign-in codes and arrival notices that name your taxi company, may come from a phone number shared by several companies on SmartCabPro. Replying STOP stops all texts from that number, including sign-in codes for any company that uses it. Reply START to receive texts again. See our SMS Policy.

App notifications. If you turn on notifications, the Passenger App may alert you when your driver arrives, when your driver sends you a chat message, and before a scheduled ride. Notifications may appear on your phone's lock screen. You can turn notifications off at any time in your phone or browser settings; if you do, you will not receive those alerts in the app. Text messages are separate and are stopped by replying STOP.

Chat. In-app chat messages with your driver are deleted after the ride.

15A. Automatic Updates and App Stores

The Passenger App updates its content automatically in the background, without asking you first, so you have the latest version.

If you downloaded the Passenger App from the Apple App Store or Google Play:

16. Limitation of SmartCabPro's Responsibility

SmartCabPro provides software that facilitates ride requests.

SmartCabPro is not responsible for:

17. Passenger Responsibilities

Passengers agree to:

Repeated or serious violations may result in suspension or termination of the passenger account.

18. Suspension and Termination

SmartCabPro or the applicable Transportation Provider may suspend or terminate a passenger account where reasonably necessary due to:

18A. Deleting Your Account

You may delete your passenger account in the Passenger App by going to Account > Delete my account.

Deleting your account removes your name and photo from your profile at the taxi company the app is connected to (a company's branded app, a company link, or the SCP Rider app connected with a company code), and removes that app's push notification registrations for that company. Your profile at any other taxi company is not affected, and your phone number can still be used to sign in there. To remove your name and photo at every taxi company you have used, email admin@smartcabpro.com and include the phone number linked to your account; we may text a code to that number to confirm it is yours.

Addresses a taxi company keeps in its own address book, and saved places and preferences stored on your phone, are not removed by this button. To remove them, ask the company or email admin@smartcabpro.com, and uninstall the app or clear its data.

Your phone number and past trips stay with the taxi company as its business records. If you sign in again later, you will be asked for your name again.

19. Changes to These Terms

SmartCabPro may update these Rider Terms from time to time.

Material changes may require passengers to review and accept the updated Terms before continuing to use the Passenger App.

21. Governing Law

These Rider Terms are governed by the laws specified in the applicable Platform Service Agreement, except where mandatory local law requires otherwise.

These Terms become effective upon electronic acceptance or first use of the Passenger App after they are presented.
